Sau khi Việt Nam và Malaysia nộp báo cáo chung về thềm lục địa mở rộng ngoài khơi miền Nam, và Việt Nam nộp báo cáo về thềm lục địa mở rộng ngoài khơi miền Trung, Trung Quốc đã phản đối hai báo cáo này.

Theo quan điểm của tôi, các phản đối của Trung Quốc không dựa trên quy định khoa học nào của UNCLOS về việc tính phạm vi vùng đặc quyền kinh tế hay thềm lục địa, mà chỉ nói rằng nước này có chủ quyền không ai tranh cãi được đối với các đảo trong Biển Đông và các vùng biển lân cận.
Trung Quốc cũng nói họ có chủ quyền đối với biển và thềm lục địa trong các liên quan, như trong bản đồ đính kèm theo phản đối.
Bản đồ Trung Quốc đính kèm với các phản đối chỉ vẽ một ranh giới biển duy nhất: ranh giới lưỡi bò.

Việc phản đối của Trung Quốc có hai ý nghĩa.
Thứ nhất, rõ ràng là Trung Quốc khẳng định là biển và thềm lục địa bên trong ranh giới lưỡi bò là thuộc về nước này.
Có lẽ đây là lần đầu tiên Trung Quốc chính thức khẳng định điều này với một cơ quan của LHQ.

Theo thiển ý, đây là một sự leo thang về ngoại giao mà hiện chưa thấy Việt Nam và các nước Đông Nam Á đáp trả như thế nào.
Mặc dù ranh giới lưỡi bò không phù hợp với UNCLOS, có lẽ là việc phán quyết về điều đó nằm ngoài thẩm quyền của Ủy ban Ranh giới Thềm lục địa.
Ủy ban sẽ không xét các báo cáo của Việt Nam và Malaysia vả đây là một thiệt hại cho hai nước này trong khi các cơ quan của họ đã thi hành đúng những nghĩa vụ mà UNCLOS đòi hỏi.
Theo ý kiến riêng, bất kể Ủy ban Ranh giới Thềm lục địa sẽ quyết định thế nào, Việt Nam, Malaysia,
Philippines, Brunei và Indonesia cần có một chiến dịch ngoại giao, thông tin để đáp trả quyết định thang mới của Trung Quốc.
Ngoài chiến dịch ngoại giao và thông tin, Việt Nam, Malaysia, Philippines, Brunei và Indonesia cần có những biện pháp pháp lý, thí dụ như yêu cầu Toà án Công lý Quốc tế ban một Ý kiến Tư vấn về phạm vi của các vùng biển thuộc các đảo trong quần đảo Hoàng Sa, Trường Sa.
Ý kiến Tư vấn của Toà về một phạm vi nhất định sẽ cản trở việc Trung Quốc lợi dụng tranh chấp Hoàng Sa, Trường Sa để tranh chấp biển và thềm lục địa một cách quá mức.

Vietnam's submission on continental shelf illegal

BEIJING - China on Friday refuted Vietnam's submission of a report on outer limits of continental shelf to the United Nations, saying its claim, which infringes upon China's sovereignty, sovereign rights and jurisdiction over the South China Sea, is illegal and invalid.
Chinese Foreign Ministry spokesman Ma Zhaoxu made the remarks on Friday when asked for comments on Vietnam's submission on outer limits of continental shelf to UN Commission on the Limits of the Continental Shelf (CLCS).
"China has indisputable sovereignty over the Xisha and Nansha Islands and their adjacent waters, and has sovereign rights and jurisdiction over the seabed and subsoil in the region," Ma said.
Malaysia and Vietnam presented a joint submission to the United Nations on Wednesday, one week before the May 13 deadline set by the United Nations for countries to submit claims over extended continental shelves.
On Thursday Vietnam presented a separate report.
But according to the Rules of Procedure of CLCS, "in cases where a land or maritime dispute exists, the commission shall not consider and qualify a submission made by any of the states concerned in the dispute."
Ma said the Chinese Permanent Mission to the United Nations had already presented a note to UN Secretary-General Ban Ki-moon.
"The Chinese government expatiated its solemn and just stance in the note, and urged the CLCS not to consider the submission in line with the United Nations Convention on the Law of the Sea and the Rules of Procedure of CLCS," Ma added.

UNITED NATIONS, May 7 (Xinhua) -- The Chinese Permanent Mission to the United Nations presented a note to UN Secretary-General Ban Ki-moon on Thursday, urging the Commission on the Limits of the Continental Shelf (CLCS) not to review the joint submission of information by Malaysia and Vietnam on the outer limits of the continental shelf beyond 200 nautical miles, a Chinese mission spokesman told Xinhua.
Malaysia and Vietnam presented the joint submission to the United Nations on Wednesday, infringing upon China's sovereignty, sovereign rights and jurisdiction in the South China Sea, the Chinese mission said in the note.
The Chinese government, therefore, solemnly urged in the note that the CLCS not to consider the joint submission of information in accordance with the United Nations Convention on the Law of the Sea and the Rules of Procedure of CLCS, the spokesman said.
The joint submission came about one week before the May 13 deadline set by the United Nations for countries to submit claims over extended continental shelves.
According to the CLCS Rules of Procedure, "in cases where a land or maritime dispute exists, the commission shall not consider and qualify a submission made by any of the states concerned in the dispute."
With the opposition from China, the CLCS will not consider the joint submission in line with the Rules of Procedure, the spokesman added.
