Dear Sir

I am a representative of the Prisoners of Conscience Fund and as a group we would like to raise an issue concerning the case of a psychological warfare personnel, Nguyen Huu Cau, from the former army of Republic of Vietnam.
On the 17th of May 2010, a prisoner from Vietnam was released from jail and informed us about Nguyen Huu Cau. Cau has been incarcerated in a section of Xuan Loc Camp serving a life sentence. This particular section is specifically for political prisoners. It has been 28 years since he was sentenced. During this time Cau has submitted numerous applications to the Vietnam courts, requesting them to reconsider his case, however, they have been intercepted and blocked.
The Prisoners of Conscience Fund have investigated this case and have contacted former prisoners who have been incarcerated with Cau at the camp. We have also managed to contact his daughter. Through our investigation we have been handed a letter written by Cau (Secretly delivered via one of the released prisoners who was with him) describing his situation to the outside world. From this information, we have uncovered a grave injustice.
Cau has been wrongly and unjustly condemned for daring to speak out. The cause of this began when Cau had spoken out against two local government officers. These two officers, one the director of the Institute of People’s Procuracy and the other a provincial Vice President, were performing indecent acts of rape and bribery. Cau had spoken out against them for these acts, and as a consequence he has been sentenced to life. The two officers had purposely sent out disinformation about Cau to criminalize him and ‘cover up’ their wrongdoings. Cau’s sentence began in 1982, his punishment was for music he’s never written that was supposedly ‘damaging’. ‘Damaging’ to who or what was not stated in the law suit, however, this was obviously seen as denting the government image.
Even if this crime was plausible, the extremity of the punishment received is unrealistic, unfair and a violation of Human Rights which Vietnam has agreed to abide by. We ask you to raise his case to the Vietnamese authority and request his immediate release or request for him to receive a fair trial.

Tôi là người đại diện cho quỹ Tù Nhân Lương Tâm, xin được bầy tỏ lòng quan tâm đến ông Nguyễn Hữu Cầu, một người lính tâm lý chiến của quân lực Việt Nam Cộng Hoà.
Vào ngày 17/5/2010, một tù nhân ở Việt Nam được thả đã cho chúng tôi biết về ông Nguyễn Hữu Cầu. Ông Cầu bị biệt giam ở trại Xuân Lộc với án tù chung thân, nơi biệt giam này dành riêng cho tù nhân chính trị. Đã 28 năm qua, ông Cầu đã gởi nhiều đơn xin tái cứu xét đến toà án Việt Nam, tiếc thay tất cả đã bị kiểm duyệt và chặn lại.
Quỹ Tù Nhân Lương Tâm đã nghiên cứu trường hợp này và đã liên lạc với nhiều tù nhân khác ở cùng trại với ông Cầu, chúng tôi đã liên lạc với con gái ông Cầu và được trao cho một lá thư viết tay (được bí mật qua tay người tù mãn hạn cùng trại đem ra) kể về hoàn cảnh của ông với thế giới bên ngoài. Từ nhừng thông tin này, chúng tôi khám phá ra một sự mờ ám bất công.
Ông Cầu đã bị kết án oan chỉ vì lời nói dũng cảm của ông ấy. Nguyên nhân gây ra là ông Cầu đã lên tiếng chống lại hai người cán bộ nhà nước. Một là viện kiểm sát nhân dân tỉnh và phó chủ tịch ủy ban nhân dân tỉnh về hành động hiếp dâm và nhận hối lộ. Hai cán bộ nhà nước kia đã cố tình bôi xấu và vu khống ông Cầu đã sáng tác bản nhạc mà ông không bao giờ viết để trả thù và bịt miệng ông cầu bằng án tù chung thân, với tội danh là "Phá Hoại" phá hoại ai, cái gì thì không được trình bầy trong bộ luật, tuy nhiên, rõ ràng được xem như bôi nhọ hình ảnh chính quyền.
Ngay cả vụ án này có thể đúng, thì hình phạt cực kỳ dã man này không phù hợp, nó bất công và là một sự vi phạm nhân quyền mà Việt Nam đã ký ước tuân thủ. Chúng tôi mong mỏi nơi ông trình bầy hoàn cảnh của ông Cầu vói nhà câm quyền Việt Nam, yêu cầu họ lập tức thả hoặc cho ông Cầu được một phiên toà công bằng.
