Ngày 6 tháng 8 năm 2009, trang web của Đảng Dân Chủ Việt Nam bị kẻ gian tại Việt Nam tấn công, chiếm lấy tên miền ddcvn.org và các tên miền khác. Trong thời gian phục hồi lại tên miền cũ, trang www.ddcvn.info là trang web chính thức của Đảng Dân Chủ Việt Nam, kể từ hôm nay, 24 tháng 8 năm 2009.
Việc lấy cắp mật mã email, phá hoại các trang mạng thông tin, cài virus trên mạng internet là hành vi vi phạm pháp luật. Đây là hành động tội phạm. Đảng Dân Chủ yêu cầu Nhà nước Việt Nam hợp tác ngăn chặn tình trạng tin tặc lộng hành này.

Ngày 19 tháng 8 năm 2009, truyền hình Nhà nước Việt Nam trình chiếu đoạn băng “nhận tội, xin khoan hồng” của bốn anh em dân chủ bị bắt gần đây: Thạc sĩ Nguyễn Tiến Trung, Tổng giám đốc Trần Huỳnh Duy Thức, Luật sư Lê Công Định và cựu Trung tá Trần Anh Kim.
Trước sự việc này, Đảng Dân Chủ Việt Nam khẳng định:

Tất cả các anh em bị bắt nêu trên đều vô tội. Các anh em đều là những người yêu nước, thượng tôn pháp luật, hoạt động vì quyền lợi dân tộc, vì mục tiêu xã hội công bằng, vì lợi ích của Tổ quốc Việt Nam. Những phát biểu ráp nối trong màn “nhận tội” và “xin khoan hồng” của anh em đã nói lên các vấn đề trong xã hội như là một bản cáo trạng khá đầy đủ các sai trái của chế độ hiện hành. Đây là những hy sinh về tự do, danh dự của các anh em, đáng được ghi nhận.

Đoạn băng được trình chiếu nêu trên hiển nhiên do các cơ quan của đảng cầm quyền dàn dựng và thực hiện cả về hình thức và nội dung. Các anh em chỉ là nạn nhân của sức ép trong trại giam với những thủ đoạn và áp lực khó tránh. Đây là vấn đề không bình thường của một Nhà nước, làm xấu bộ mặt pháp lý của chế độ. Nhớ lại trường hợp tù binh John McCain tại trại giam Hỏa Lò, Hà Nội, cũng đã “nhận tội” để đáp ứng cho áp lực của Cộng Sản, dù theo luật của quân đội không ai được phép làm như vậy. Nhưng khi được trả tự do về lại Hoa Kỳ, ông John McCain cũng đã được Tổng thống Nixon tiếp đón ở Bạch ốc và đã trở thành Dân biểu, Thượng Nghị sĩ, ứng cử viên Tổng thống của Hoa Kỳ. Đó là trường hợp của tù binh thời chiến cách đây cả gần nửa thế kỷ. Nhưng trong thời bình, trước các hoạt động dân chủ của công dân mà Nhà nước Việt Nam vẫn hành xử như vậy, thì quả là lạc hậu, ngược với mục tiêu tiến tới xã hội công bằng, dân chủ, văn minh.

Nếu hoạt động của anh em dân chủ là vi phạm pháp luật thì Nhà nước hãy xét xử theo quy định của pháp luật. Và theo quy định của pháp luật thì không một ai bị xem là có tội khi chưa có bản án kết tội của Tòa án. Cho nên những lời nhận tội đó không có giá trị về phương diện pháp lý.

Trong khi chưa có bản án của toà án mà Nhà nước đã cho dàn dựng, đạo diễn buộc anh em dân chủ “nhận tội” và đem trình chiếu trên truyền hình như vậy, rõ ràng là đảng cầm quyền cố ý bôi nhọ cá nhân anh em và các hoạt động dân chủ. Điều này cho thấy đảng cầm quyền đã lúng túng không ít trước sự chỉ trích từ phía công luận trong và ngoài nước về những vụ bắt giữ. Việc phải “nhận tội” mà không có tội đã là một vở kịch trái pháp lý và đạo lý xã hội. Càng tệ hơn khi truyền thông nhà nước phổ biến trên truyền hình.

Việc đảng cầm quyền vẫn còn đối xử với những người yêu nước hoạt động cho sự tiến bộ của xã hội như những tù binh trong trường hợp này là không phù hợp với xã hội văn minh. Hoạt động dân chủ ôn hòa là quyền công dân và tốt cho xã hội. Pháp luật Việt Nam không cấm công dân sinh hoạt chính trị. Đảng Dân Chủ hoạt động cũng đã nhiều năm nay tại Việt Nam và Nhà nước Việt Nam chưa hề có một văn thư nào cấm Đảng Dân Chủ Việt Nam hoạt động.

Vì những lý do trên, Đảng Dân Chủ Việt Nam nay yêu cầu Nhà nước CHXHCN Việt Nam hãy nhận thức đúng và trả tự do vô điều kiện cho bốn anh em nêu trên và tất cả các anh chị em hoạt động dân chủ đang bị giam giữ. Nhà nước cần ngăn chặn chấm dứt tình trạng đàn áp, giam cầm, vu khống, bôi nhọ các chí hữu Dân Chủ. Nhà nước hãy thực sự thực hiện xã hội công bằng, dân chủ và chủ trương đoàn kết dân tộc. Với chủ trương đó, Nhà nước cần ý thức: chế độ độc tôn độc đảng không thể xây dựng nhà nước pháp quyền đúng nghĩa; hoạt động chính trị ôn hòa không vi phạm pháp luật; và, giữa người Việt Nam không có thù địch.

STATEMENT TO THE MEDIA

On August 6, 2009, the website of the Democratic Party of Vietnam was attacked by hackers from Vietnam. The hackers fraudulently transferred our main domain name, ddcvn.org, and other domains to another server. While waiting for the return of our original domain name, the new website www.ddcvn.info is the official website of the Democratic Party of Vietnam starting on August 24, 2009.
The stealing of email passwords, hacking of websites, and infecting other people’s computers with viruses via the internet are illegal acts not only in Vietnam. This is a criminal act. The Democratic Party of Vietnam requests the cooperation of Vietnam’s government in stopping these criminal hackers.

On August 19, 2009, Vietnam’s government allows the media to run video footages showing the four democracy activists “confessing, asking for clemency”, including Nguyen Tien Trung, Tran Huynh Duy Thuc, Le Cong Dinh, and Tran Anh Kim. The Democratic Party of Vietnam has the following statement:

All democracy activists mentioned above are innocent. All are true patriots, law-abiding citizens, acting in the interest of the people, and all share the goal of creating a just society. The “confession” and “asking for clemency” footages speak for themselves about everything that is wrong with society, and are a nearly complete indictment against the current regime. The footages also show the sacrifice of freedom and dignity of our democracy activists.

The video footages are obviously the work directed, in both the form and contents, by government offices of the party in power. The democracy activists are victims of the pressure they face while being jailed and the coercion of security agents. Recall the former prisoner of war, Mr. John McCain, at Hoa Lo prison, Hanoi, 40 years ago. Mr. John McCain also “confessed and asked for clemency” to satisfy the demand of the communists, despite US military law prohibiting him from doing so. But after his release and return to the US, Mr. McCain was greeted by President Nixon at the White House. Mr. McCain was elected to Congress and became a well-known senator for nearly a quarter of a century. Recently, Senator McCain was a Republican presidential candidate in the last election. That was the case of a prisoner of war half a century ago, but in the time of peace, when facing democratic activities, security agencies still act in a backward manner, contradicting the government's goal of creating a just and democratic society.

If the activities of our democracy activists violate the law, the government must try their cases in a court of law. By the provisions of the law, no one is considered guilty until the court issues its guilty verdict. Therefore, such confession has no legal value.

While there has been no official verdict of the court, the government already directed and set up our democracy activists to “confess” then showed the footage on television. Clearly, the party in power intentionally smeared these democracy advocates and democratic activities. It also shows that the party in power is acting erratically when facing pressure from public opinion within the country and abroad regarding the recent arrests. Having to “confess” on television while still not proven guilty is a ridiculous drama defying legal and moral values of society.

The fact that the party in power still treats the people who love their country and contribute to the betterment of society as prisoners is inappropriate in a modern society. Democratic activities are the rights of the citizen, and they benefit society. The law of Vietnam does not prohibit political activities. The Democratic Party of Vietnam has been present in Vietnam for many years. Vietnam’s government has never issued any official document to prohibit the Democratic Party.

With the reasons stated above, the Democratic Party of Vietnam requests that the government of the Socialist Republic of Vietnam completely stop the oppression, imprisonment, slandering, and smearing of members of the Democratic Party. The government must truthfully practice its policy of unity and govern society according to the law. With that policy, the government must realize: a totalitarian regime cannot build a rule-of-law state with its true meaning; peaceful political activities do not violate the law; and, there are no enemies among Vietnamese people.
